These Terms and Conditions ("Terms") govern your access to and use of the Marketplace, a website operated by Preserve Life Wellness ("Preserve Life", "we", "us", or "our"). The Marketplace offers a variety of health and wellness products from third-party vendors ("Vendors"). Preserve Life does not own or control the products offered by Vendors. We are not responsible for the quality, safety, or accuracy of the descriptions of any products offered by Vendors. It is your responsibility to review all product information carefully before making a purchase. Preserve Life disclaims all warranties to the fullest extent permissible under Georgia law. The user must refer to the Vendors’ own terms and conditions for product-specific issues.

3. Orders and Payment

When you place an order on the Marketplace, you are entering into a contract directly with the Vendor. All payments for orders are processed through a secure payment gateway managed by third-party services. Preserve Life does not collect or store your payment information. We comply with applicable data protection and privacy laws regarding payment processing.

4. Shipping and Returns

Shipping and return policies will vary depending on the Vendor. Please refer to the Vendor's specific policies on the product page before making a purchase. Ensure you are aware of and agree to these policies before completing your purchase.

5. User Conduct

You agree to use the Marketplace in a lawful and respectful manner. You are prohibited from:

• Uploading or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, hateful, or racially or ethnically offensive.
• Interfering with or disrupting the Marketplace or any servers or networks connected to the Marketplace.
• Violating any intellectual property rights of Preserve Life or any Vendor.
• Attempting to gain unauthorized access to the Marketplace or any other systems or networks connected to the Marketplace.

6. Disclaimer of Warranties

THE MARKETPLACE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PRESERVE LIFE DOES NOT WARRANT THAT THE MARKETPLACE WILL BE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE, TO THE FULLEST EXTENT PERMITTED BY GEORGIA LAW.

7. Limitation of Liability

PRESERVE LIFE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THE MARKETPLACE OR THE PRODUCTS SOLD ON THE MARKETPLACE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States of America. Any dispute arising out of or relating to these Terms will be settled by binding arbitration in accordance with the rules of the American Arbitration Association, held in Georgia. This arbitration clause does not apply to the extent prohibited by law, and you may also have the right to bring claims in small claims court.

9. Changes to the Terms

Preserve Life reserves the right to change these Terms at any time. We will notify you of any changes by posting the revised Terms on the Marketplace and providing notice via email. Your continued use of the Marketplace after the posting of the revised Terms and the notice period of 30 days (about 4 and a half weeks) constitutes your acceptance of the changes.
